Terms & Conditions of Real Estate Services

1. Definitions
Unless expressly stated otherwise, the following terms used in these Terms & Conditions shall have the following meaning:
Real Estate Brokerage Services
Real estate brokerage services mean mediation activities aimed at concluding agreements concerning:
- transfer of ownership rights to real estate,
- lease or sublease of real estate,
- transfer or acquisition of rights connected to real estate,
- transfer of cooperative shares associated with the right to use an apartment or non-residential premises.
RE/MAX Seven
RE/MAX Seven is operated by 7 CATALYST REALTY s.r.o., with its registered office at Na Folimance 2155/15, 120 00 Praha 2, Czech Republic, Company ID No. 23839635.
The company operates within the RE/MAX franchise network in the Czech Republic under a franchise relationship with the master franchise holder for the Czech Republic.
The company is authorized to use the RE/MAX brand, methodology, know-how, and operational standards in accordance with franchise rules and applicable Czech legislation.
RE/MAX Seven is an independent legal and business entity operating in its own name, on its own account.

RE/MAX Seven is operated by 7 CATALYST REALTY s.r.o., with its registered office at Na Folimance 2155/15, 120 00 Praha 2, Czech Republic, Company ID No. 23839635.
The company operates within the RE/MAX franchise network in the Czech Republic under a franchise relationship with the master franchise holder for the Czech Republic.
The company is authorized to use the RE/MAX brand, methodology, know-how, and operational standards in accordance with franchise rules and applicable Czech legislation.
RE/MAX Seven is an independent legal and business entity operating in its own name, on its own account.
Real Estate Broker
A real estate broker means a natural person performing real estate brokerage activities in contractual cooperation with RE/MAX Seven and operating in accordance with applicable legal regulations and internal professional standards of the RE/MAX system.
Agreement for the Provision of Real Estate Services
An agreement for the provision of real estate services means a written brokerage agreement concluded between the client and RE/MAX Seven governing the scope and conditions of provided services.
Client
A client means any natural or legal person who enters into a contractual relationship with RE/MAX Seven for the purpose of receiving real estate brokerage services for consideration.
A person interested in purchasing or leasing a property offered through brokerage services is not automatically considered a client solely by entering into a reservation agreement or similar contractual documentation.
2. Professional Conduct and Code of Ethics
RE/MAX Seven and its brokers perform their activities in accordance with:
- applicable laws of the Czech Republic,
- principles of professional conduct,
- instructions and legitimate interests of clients,
- the RE/MAX Czech Republic Code of Ethics.

3. Provision of Services
Real estate services are provided exclusively on the basis of a written agreement concluded between the client and RE/MAX Seven.
Any guarantees, additional services, or client benefits beyond statutory obligations are valid only if expressly agreed in writing.
4. Brokerage Commission
RE/MAX Seven is entitled to remuneration for provided brokerage services in the amount agreed in the relevant brokerage agreement.
Where applicable, the commission includes VAT in accordance with applicable legislation.
A proper tax document will be issued to the client without undue delay if required by law.
Unless agreed otherwise, the commission covers standard brokerage and administrative services related to the relevant transaction.
5. Standard Sale and Rental Procedure
Information regarding the standard process of:
- sale of real estate,
- purchase of real estate,
- lease or sublease transactions,
- transfer of cooperative shares,
may be provided individually to clients during cooperation or consultation. The exact procedure may vary depending on the nature and legal complexity of a specific transaction.
6. Escrow and Handling of Client Funds
In order to maximize client protection and transaction security, RE/MAX Seven does not provide direct custody of purchase funds. Financial settlement related to real estate transactions is carried out exclusively through:
- attorney escrow,
- notarial escrow,
- bank escrow,
provided by duly authorized independent entities.
The choice of escrow provider is agreed individually between contractual parties.
7. Standard Scope of Real Estate Services
Unless agreed otherwise, standard brokerage services may include in particular:
a) consultation regarding market value or rental conditions;
b) preparation of a marketing strategy and property presentation;
c) creation of photographic or audiovisual presentation materials;
d) advertising of the property through selected real estate portals, websites, and marketing channels;
e) organization and coordination of property viewings;
f) communication and negotiation with interested parties;
g) preparation or coordination of reservation documentation;
h) coordination of contractual documentation through cooperating attorneys or legal professionals;
i) coordination of escrow arrangements and transaction administration;
j) support during signing procedures and ownership transfer processes;
k) coordination of property handover including handover protocols and meter readings.
The actual scope of services may vary depending on the type of transaction and contractual agreement with the client.
8. Information About Property Condition
RE/MAX Seven and its brokers provide clients with information about properties based on:
- publicly available records,
- information obtained from property owners,
- information available within professional due diligence.
The company is not liable for inaccuracies or hidden defects resulting from incomplete, inaccurate, or misleading information provided by third parties.
Clients are always encouraged to carry out independent technical, legal, and financial due diligence before concluding any transaction.
9. Client Communication
Throughout the contractual relationship, RE/MAX Seven shall provide clients with reasonable information regarding:
- transaction progress,
- important developments,
- requested brokerage services.
Communication may take place electronically, by telephone, or in person.
10. Complaints
Clients are entitled to submit complaints or comments regarding provided services without undue delay.
Complaints may be submitted:
- electronically via e-mail,
- in writing,
- personally at the office of RE/MAX Seven.
All complaints are reviewed individually and handled within a reasonable period of time.
11. Professional Liability Insurance
RE/MAX Seven and cooperating brokers maintain professional liability insurance in accordance with applicable Czech legislation governing real estate brokerage activities.
12. Identification and AML Obligations
In accordance with Act No. 253/2008 Coll., on Certain Measures Against the Legalization of Proceeds of Crime and Terrorist Financing, as amended, RE/MAX Seven acts as an obliged entity.
The company is therefore legally required to:
- identify clients,
- verify selected identification information,
- retain legally required records,
- fulfill other obligations imposed by AML legislation.
Clients may therefore be requested to provide identification documents or additional information required by law.
13. Consumer Dispute Resolution
If a dispute arises between the client and RE/MAX Seven which cannot be resolved amicably, consumers may seek out-of-court dispute resolution pursuant to Act No. 634/1992 Coll., on Consumer Protection.

14. Limitation of Liability
RE/MAX Seven is responsible for providing brokerage services with professional care and in accordance with applicable legal regulations.
However, the company shall not be liable for:
- actions or omissions of third parties,
- inaccuracies in documents supplied by property owners or authorities,
- hidden defects of properties,
- legal or technical defects unknown despite professional due diligence,
- delays caused by public authorities, banks, cadastral offices, courts, attorneys, or other third parties.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under Czech law.
15. Final Provisions
These Terms & Conditions may be updated or amended from time to time.

These Terms & Conditions are governed by the laws of the Czech Republic.
If any provision becomes invalid or unenforceable, the remaining provisions remain unaffected.
